July 2021 – EU Nationals in the UK

Back in May, both the DWP and HMRC sent letters to people that, based on a data matching exercise with the Home Office, they believe may need to apply to the EU Settlement Scheme (EUSS), before the deadline of 30 June 2021.

Most people (including family members) from the EU, Switzerland, Norway, Iceland or Liechtenstein who started living in the UK by 31 December 2020 and without settled status needed to apply to the EUSS if they wanted to remain in the UK.

People with indefinite leave to enter (ILE) or indefinite leave to remain (ILR), already have settled status and so were not required to apply to the scheme (although they may choose to).

It has now been confirmed that EU citizens who missed the 30 June 2021 deadline for applications to the EUSS will not see their benefit payments stop automatically from 1 July 2021 and they may still be able to apply to the scheme. Individuals will need to have reasonable grounds for why they did not apply by the deadline.

There are many different reasons that can be included as reasonable grounds for not applying by the deadline including:

Your parent, guardian or local authority did not apply for you when you were a child

You have, or had, a medical condition which prevented you from applying

You have care or support needs, or those caring for you were unaware of the deadline

You have been the victim of modern slavery

You have been in an abusive or controlling relationship

       You did not have internet access, or access to relevant documents
